It's about operating separate automonous households that do NOT have to confer, because EACH can do whatever the heck it wants to, consistent or not, approved by the other parent or not. 

This page was inspired by the "KidMate" joint custody software ad on page 35 of the Spring 1999 Family Advocate, Vol 21, No.4, American Bar Association. A decade later, the opportunism and commercialism are geometrically worse.

Relevant Strategic Plan Goals and Operational Plan Objectives

All of the Judicial Council’s strategic plan goals are addressed by the recommendations of the Elkins Family Law Task Force, as follows:

Goal I, Access, Fairness, and Diversity. This goal is addressed by recommendations to increase self-help services and the availability of legal representation, make family law rules of court more comprehensive, streamline family law forms and procedures, and improve litigant education. These recommendations also would help achieve Goal I’s operational objective 2a and 2b by helping trial courts achieve efficiency and fairness in family law proceedings and ensure access to justice for litigants.

Goal II, Independence and Accountability. The recommendations to develop and implement a family law research agenda, which would include workload studies and performance measures, would help the courts assess resource needs and improve operational decisionmaking concerning resource allocation.

Goal III, Modernization of Management and Administration. Implementing caseflow management would help courts modernize the administration of family law cases. Increasing the availability of electronic filing, telephonic appearances, and electronic access to the courts are innovative practices that also address this third goal. These recommendations support objective 5 of the operational plan, as they would promote the fair, consistent, and efficient processing of cases in family court.

Goal IV, Quality of Justice and Service to the Public. The recommendations concerning live testimony and providing settlement assistance to self-represented litigants would improve the quality of justice in family law cases. The recommendation that courts should give community presentations on available court services, especially to communities that may be underserved by the courts, supports the goal of service to the public.

Goal V, Education for Branchwide Professional Excellence. A number of recommendations to improve judicial branch education programs, including the development of curricula, would allow courts to more effectively address children’s needs. The education recommendations also support the underlying operational objective of providing judicial officers with relevant and accessible educational and professional development opportunities.

Goal VI, Branchwide Infrastructure for Service Excellence. The recommendations to improve court facilities and make them more responsive to the needs of family court users further the infrastructure goals.

REFLECTIONS ON LOSING YOUR FAMILY AND HOME: IT’S COMMON FOR NONCUSTODIAL MOMS

I had left work the other day for a little while…when I got back I found a prize from a child’s meal on my desk. Obviously left for one of my children by a coworker. I sighed and put it in my side drawer.

My coworkers have no clue that I have not seen my children in over a year. I haven’t talked with them, no pictures, nothing.  My coworkers know little of the custody battle that ensued almost constantly for five years, not only until my abuser had them, but not stopping until he managed to have all contact cut off, while crushing me financially. I have had to back away from close relationships to hide the fact that my children are no longer around. That frequently I don’t have a place to live, and my mechanically-challenged vehicle often serves as home. Folks think I have shared custody with my abuser (up to that point he had not abused the children…it has changed now as it often does), something that I asked for in court, not knowing that he was asking for sole custody (gee, aren’t your own lawyers suppose to be straight with you and tell you what’s going on?).  I avoid contact with local friends and coworkers so that conversation doesn’t lead to the children. But every once in a while, something like this happens, and my heart breaks a little more.  Other moms in this position understand, but most people don’t.  Only drug-using, psycho, bank robbing moms lose their kids.  (Yeah, right).  So often we suffer in silence, for if we speak out, we are punished.  So I trod off to the library or some free wifi spot every night to work on the internet on this issue.  I have hope that someday, someone will wake up and see what is happening to moms who have been abused.  It is starting to happen.

I was at another mom’s home the other night.  She had not seen or heard from her children in over a year also.  This is more common than you think.  Once a custody case starts sliding down that slippery slope, with your abuser getting a group of court whores together to give their paid-for testimony (which has nothing to do with reality), it won’t stop until he has cut off contact between you and your children.  Draining you financially and collecting child support will be the icing on the cake for him.   She spoke about the lack of support from her own family, and I have seen this as a common situation for moms also.  My friend told me her mother dropped her phone line, using only a cell phone now, and wouldn’t give her the phone number.  The siblings will not have anything to do with her.  During a time that a mom needs the most support, her own family drops her.  I cried with her because I understood.  My own family did the same thing.  Other than my own mother, who truly did understand because she had lost custody to her abuser (my father) when we were young, everyone else thought….”well, if a court found you not to be the best parent, then something must be wrong with you.”  My mother didn’t live to see what did end up happening, because she died an early death, no doubt tied to the abuse and stress of losing her children.  She would have understood the pain.  She died tortured by the thought I may lose my children also because abusers don’t stop until they have them.  And that breaks my heart even more.   So feel blessed if you have family standing with you, because this often isn’t the case.  If you are a mom whose family has dropped you like yesterday’s trash, you are not alone.

One more thing to touch on…a challenged mom called me last night, wondering what it was going to be like to start living in her van.  She wanted to know how I dealt with it when I first had to move into my vehicle.  I had watched this mom on the slippery slope over the past year…with her abusive ex-boyfriend eventually taking and cutting off all contact with the two young daughters about two months ago.  Again, upon the wishes of the control-freak ex-boyfriend, the biased court and the well-paid court whores overtake this previous stay at home mom like a pack of wolves after a newborn fawn, and destroy her.  She was court-ordered to pay over $900 a month in child support, and I am sure she doesn’t make that working the temporary jobs she is able to get as a low-skilled worker.  (BTW, the ex and his wife makes BUCKETS full of money).  I tried to comfort the mom…”it’s spring now sweetie, at least it won’t be so cold out now.”  I told her when I first started living in my vehicle, I had so many things go on at once so that the act of actually staying there was not as big of a deal as other things, like worrying about my children, who were now starting to be abused too.  Worrying about whether my vehicle would break down (which it has twice over the past year).  There are a significant group of moms I know that are homeless, so this isn’t a rarity either.  If you are in this situation, know you aren’t alone.  Don’t let it stop you though…keep moving forward to do what you can to change the system and get access to your children back.

"Men's rights lawmakers planning law to take children from mothers as much as they can get away with.”

 

Despite the opposition from women's groups, judges, and the Tennessee Bar Association, the men's rights lawmakers continue their attempts to impose harmful custody and divorce laws on women and children. There seems to be no thought involved that this will lead to more deaths of women and children who will be unable to escape from abusive situations. Despite the token wording "except for in cases with abuse" as often put in custody bills to placate the domestic violence coalitions, this provision does NOT work because it is nearly impossible to prove abuse with the horde of father's rights attorneys and hired-gun experts who for a fee will malign the victim and undermine her credibility to the point where the victim is declared to either be a liar or mentally ill. This goes on every day in every state in family court. It's America's dirty little secret that women and children are treated just as badly in the United States if not worse than other more progressive countries.

This new custody bill is calling for 50/50 forced custody for children unless the parents can agree on their own plan. It seems the vast majority of divorces with children do create their own schedule per the Tennessee Bar Association's report on joint custody dated March 23, 2010. So this custody bill is the WORST idea ever as parents who can't agree generally have a reason and it is usually abuse. The abuser will claim to be falsely accused and say that the protective parent is an "alienator." The whole scenario repeats itself in case after case with horrible results that are going largely ignored in this fatherhood-exalting, mother-hating society. Mothers who fear for their children's safety are being ordered under threat of losing their children or going to jail to turn their children over to abusive fathers. The worst case scenario has occurred many times over. So why are the Tennessee men's rights lawmakers pushing for a law that will only serve to help abusive men have access to children?

This bill has all male sponsors, Mike Bell, Stacey Campfield, G.A. Hardaway, Dewayne Bunch, and Bill Ketron. Tennessee does not have 50/50 representation of lawmakers, as in 50% men and 50% women so that it might be possible to actually represent women more appropriately. Tennessee has 8 female Senators out of 33, and 15 female Representatives out of 99. That is 24% female representation in the Senate and 15% in the House. There needs to be a law passed requiring that women have equal representation. The mother-child bond needs to be adequately protected and women's contribution of risking maternal death to bring another life into the world should not minimized. Tennessee is ranked 38th among the states for maternal health. Out of 100,000 births, about 12 women will die in childbirth. That risk is only taken by the mother, no one else, she bears that risk alone in bringing her child into the world. Besides risking death in childbirth, pregnant women are also at risk of being killed by the father of the child. Homicide is the leading cause of death of pregnant women (Chang, Berg and Herndon 2005). So instead of passing a bill that would help women protect themselves and their children, the sponsors of this custody bill want to make it next to impossible for women and children to be free from an abusive situation.

The best arrangement for a child is an individual one that brings the most happiness and stability to the child and doesn't serve to reduce the child to property that is divided like real estate. Also, give mothers the credit they deserve as they are the ones who can best determine whether there is an abusive situation.

The custody bill failed in the House, but has been placed on Senate Judicial Committee calendar for 04/27/2010.
