Whereas: Research by the Centers for Disease Control and Prevention finds that children’s exposure to traumas such as child physical abuse, incest and witnessing domestic violence have severe negative effects that can last a lifetime and that childhood adverse experiences are the major risk factors for the leading causes of illness and death in the United States[1]; and

Whereas: Domestic violence is a strong predictor of child physical abuse, increasing the risk from 5% after one violent act to 100% after 50 violent acts[2]; and

Whereas: Child sexual abuse allegations are extremely rare in custody cases (2-6%)[3], are just as likely to be true as at any other time (two-thirds are substantiated)[4], and fathers are far more likely to intentionally make false allegations (21%) than mothers (1%)[5]; and

Whereas: Domestic violence, child abuse and incest may not become known until the child’s parents separate, and abuse may begin or escalate after separation; and

Whereas: Non-scientific theories such as alienation theories which assume that the children’s reports of physical or sexual abuse are coached or fabricated by the protective parent result in children being inappropriately ordered into unsupervised contact with their identified batterers and molesters[6]; and

Whereas: Violent parents (usually fathers) are much more likely to seek sole custody and are successful about 70% of the time[7]; and

Whereas: More than 58,000 children a year are ordered into unsupervised contact with physically or sexually abusive parents following divorce in the United States[8] and a growing number of children are murdered while in their violent parents’ custody and control[9]; and

Whereas: Children’s physical and sexual safety is fundamental to their health and welfare, and must take precedence over abusive parents’ claims to custody or visitation.

Therefore: Be it resolved that:

1. A Congressional Hearing on family court abuses and corruption be convened.

2. A complete investigation be ordered by the President, requesting that the U.S. Attorney General investigate family court policies, practices and procedures in California, New York, Massachusetts, Pennsylvania, Florida, and Hawaii, states from which advocacy organizations receive an unusually high number of complaints that children are ordered to live with batterers and molesters.

3. A Federal Grand Jury be convened to ensure that these children are with their safe parents.

Mother's Day was originally started after the Civil War, as a protest to the carnage of that war, by women who had lost their sons. Here is the original Mother's Day Proclamation from 1870.

Arise then...women of this day!

Arraignment delayed for Hawaiian Gardens multiple killing suspect

LONG BEACH - A 26-year-old man charged with capital murder for a shooting rampage at his ex-girlfriend's Hawaiian Gardens home that left three people dead and two more injured last May has yet to enter a plea to the charge.

Defendant Joseph Mercado was scheduled to be arraigned Thursday morning at the Norwalk Superior Court, but the matter was postponed once more as Mercado's defense team awaits crime scene photographs and autopsy reports.

Court Commission Michael Schuur expressed concern and surprise when he learned the defense was still awaiting basic discovery in the case, which alleges three counts of murder with the special circumstance of multiple murders, a factor that could make Mercado eligible for the death penalty.

The prosecution explained the hold-up was due to reports being compiled by the Los Angeles County Sheriff's Department and the Los Angeles County Coroner's office.

"I think it's ridiculous they can't generate the reports in a reasonable amount of time," Schuur said.

The arraignment was postponed until Sept. 7, when all the outstanding reports are expected to be completed and turned over to the defense.

Visibly upset by the latest lag in the case was the family of the victims, who have attended all court dates since Mercado's arrest.

In addition to the murder counts, Mercado is charged with two counts of attempted murder, shooting at an inhabited dwelling, assault on a peace officer with an assault weapon, arson of an inhabited structure, child abuse and first-degree burglary with the special allegation that he personally used a firearm, according to the criminal complaint.

Mercado allegedly broke into his ex-girlfriend's home in the 21000 block of Devlin Avenue early May 6 and opened fire with an AK-47 rifle.

Killed in the shooting were 23-year-old Serena Tarin, the mother of Mercado's infant son; Tarin's 21-year-old brother, Alfredo Tarin Jr.; and their father, Alfredo Tarin Sr.

Two other family members were wounded, including Tarin's mother, Lucy Tarin, who was critically injured.

Mercado also allegedly tried to set the home ablaze, dousing the interior with gasoline, but failed to get the fire started.

He was shot by a Los Angeles County Sheriff's deputy as Mercado emerged from the house before 4 a.m. Mercado was treated and placed under arrest and is being held without bail, authorities said.

Sheriff's investigators said the slayings may have stemmed from a custody dispute between Mercado and his former girlfriend.

The suspect, they said, shot a lock off a door at the home and then went from room to room, killing his victims.

Six other family members, including some children, were able to escape the rampage by climbing out an upstairs window and hiding on the roof until deputies arrived, authorities said.

Prosecutors will decide at a later date whether they will seek the death penalty, said Jane Robison, the DA's spokeswoman.

Less than a week after a judge settled a dispute between parents and ordered life support removed from an Akron infant, police have charged a teenage father with murder.

John Jones, 17, already had been accused of assault for allegedly inflicting the injuries to his 10-month-old daughter, Jada, that led to her being placed on life support in March.

A months-long court battle between Jones and the baby's mother, Deja Ruiz, ended last Friday when a Summit County judge agreed with the mother's request to end life support.

Jada Ruiz Jones died later that evening at Akron Children's Hospital. Jones did not have an opportunity to appeal Probate Judge Bill Spicer's decision, according to his family.

On Thursday, Akron police signed murder charges against Jones, who continues to be held in the county Juvenile Detention Center. By law, he is expected to be tried as an adult in Common Pleas court.

Jones had been awaiting trial on felonious assault charges. However, once Jones' daughter
died, police were expected to increase the charge to murder.

Joseph Gorman, who represents Jones in his criminal case, said the father is still grieving his daughter's death while fighting to prove his innocence.

''Obviously, for a 17-year-old kid, these series of events come as a shock to him,'' Gorman said. ''He's distraught over the death of his daughter, Jada, and saddened by the court's order removing her from life support.

''Nonetheless, John continues to have the resolve necessary to fight this matter in court and he's looking forward to having a jury hear his case. We believe once they do hear the evidence, he will be found not guilty.''

A murder conviction carries a minimum life prison sentence with parole possible after 15 years.

Jones first called authorities the morning of March 19 when Jada stopped breathing. He was home with Jada, her twin, Jzmine, and their 2-year-old brother, Ty'shaun.

Ruiz, 19, was attending classes at Akron Digital Academy that morning.

Jones, who was holding the infant when Akron officers arrived, told detectives that when he went to change Jada's diaper, the infant was unresponsive.

Officials said the girl suffered brain damage from shaken baby syndrome and also had multiple fractures to her legs and arms. Jzmine also had fractured legs.

She has recovered, officials said.

All three children had been placed in the temporary custody of the county's Children Services Board.

No court date has been set to determine when Jones' case would be moved to Common Pleas court.

The attorney has established a memorial fund for Jada's mother to defray the cost of the infant's funeral and headstone.

Contributions can be made to the Jada Ruiz Jones Memorial Fund at any FirstMerit Bank branch.

The funeral is scheduled for Saturday at the Rhoden Memorial Home in Akron.

MONTCALM COUNTY -- A federal lawsuit alleges Children's Protective Services workers ignored obvious danger to 9-year-old Nicholas Braman, and kept him in his father's care despite the father's abuse conviction for using an electric cattle prod on two older sons.

"The death of Nicholas Daniel Braman would have been avoided if defendants had simply done what they were obligated to do by law to protect (the boy) from further abuse and neglect ...," attorney Gregory Wix wrote in the civil lawsuit, filed earlier this month by the boy's mother.

The tragedy gained wide attention when Nicholas Braman, along with his father, Oliver Braman, and his stepmother, Elaine Kaczor-Braman,were found dead Oct. 16, 2007, in their Stanton home. The boy was drugged before his father attached his pickup exhaust to the dryer vent of their house, flooding a bedroom with carbon monoxide.

The deaths occurred 11 days after Braman failed to appear for sentencing hearing on child abuse charges.

Adding to the heartbreak was a suicide note young Nicholas had left behind, scrawled in his childish hand, saying he wanted to be with his father and stepmother "forever and ever." While authorities say the boy was too young to make such a decision himself, a portion of his note read, "I take care of my mom and dad just like they take care of me."

The lawsuit alleges Children's Protective Services, under the state Department of Human Services, ignored evidence the boy was at risk with his father. Both a prosecutor and the boy's mother, Rebecca Jasinski of Saginaw, raised red flags.

A month before the deaths, Assistant Montcalm County Prosecutor Misty Davis told CPS that "An investigation should definitely be commenced ... . Oliver literally 'shocked' his older boys with a cattle prod repeatedly. As you know abuse to one child is abuse to all. In my opinion, there is no justification for the youngest boy to remain in the care of this man."

Two weeks later, she told authorities that Braman had pleaded guilty to child abuse charges. The response, just hours before the deaths were discovered: "We've never felt that Nicholas was at risk."

Jasinski had "begged" CPS workers in Saginaw to remove her youngest son from Braman's home, but was denied.

The state agency has admitted that the boy should have been removed from his father's home and placed with his mother.

Named as defendants are: CPS workers Sheri Tyler and Mary Sommers; supervisors Jamie Lovelace and Rhoda Dietrich: former director of the Department of Humane Services Marianna Udow; Laura Champagne, former chief deputy director; Ted Forrest, manager of CPS: and Chad Campbell, director of Community Hope Christian Counseling and Mental Health Center.

Edward Woods III, spokesman for Department of Human Services, said he could not comment on pending litigation, but said the agency continually works to improve services to children.

"Obviously, we're very concerned about the safety of children."

Children's Protective Services workers are represented by the state Attorney General's office, which would not comment on pending litigation. Harvey Heller, attorney for Campbell and the counseling center, declined to comment.

The lawsuit cited the father's "long history of abuse" of his children, including the older boys, Oliver and Tyler.

Among complaints investigated -- and denied -- by CPS, beginning in 1998, were:

• The father abused the children, and struck one so hard blood vessels broke in the child's nose.

• The father threatened to kill Nicholas, who feared his father. The father and his live-in girlfriend pulled out the children's teeth before they were ready to come out on their own.

• The father threw son Oliver off the porch and kicked him because the boy could not find his glasses.

• The father, believing that Oliver was afraid of the dark, left him miles away at night to find his way home. He did the same with Tyler. The boys told CPS workers they were beaten on their bare bottoms, and pliers were put on their fingers.

In 2006, the father was investigated for molesting a child. During that investigation, authorities learned the boys were disciplined with a cattle prod.

"Again, CPS, including defendant Lovelace, denied that the children were being abused or neglected and completely failed to 'investigate, collect evidence, or reach a disposition on the allegation that Mr. Braman used a cattle prod on his children,' according (to) the Office of the Children's Ombudsman," Wix wrote in the lawsuit.

The three boys were living with their father on Aug. 1, 2007, when the older boys called their mother and said they were running away because of abuse. The mother called CPS workers in Saginaw, but was threatened with arrest for kidnapping if she picked them up, she said.

She picked up her two older sons and brought them to Saginaw.

The next day, the boys told CPS workers about the use of a cattle prod. Braman did not deny the abuse, and was arrested by Montcalm County sheriff's deputies.

Sheri Tyler, a CPS worker in Montcalm, confirmed in an e-mail that there was no investigation, which was proper because Saginaw authorities "'did not seek removal,'" the lawsuit said.

The Office of Children's Ombudsman said that regardless of any action by Saginaw authorities, Montcalm CPS should have acted "at the earliest point it became aware of Mr. Braman's egregious acts of abuse ... ," the lawsuit said.

At a time when roads are going unrepaired because of falling tax revenues, when unemployed people are being denied benefits and so on, it strikes me as ABSURD that the Montgomery County Department of Job and Family Services has shelled out nearly $4,000 so dad BENJAMIN MILLS JR. can get free trips to California, allegedly to "visit" his 2-year-old daughter. Four free trips to California on the tax-payers' tab! Well, it would have been four, except Daddy had to cancel this last trip at the last minute. Looks like the county will eat the expenses for the cancelled trip too. Note our previous post here, and that Daddy has a previous PRISON RECORD FOR DOMESTIC VIOLENCE, and in fact has lost his custodial rights to his other children:

The Montgomery County Department of Job and Family Services has paid nearly $4,000 for Benjamin Mills Jr. of Dayton to visit his 2-year-old daughter Vanessa in California.
Approximately $1,300 was spent on a trip scheduled for this week that Mills canceled at the last minute. He was scheduled to visit with Vanessa on Wednesday under the supervision of the child’s court-appointed guardian ad litem.
Mills is engaged in a nationally publicized custody battle with Stacey Doss, a 45-year-old single mother who wants to adopt Vanessa. “This was to have been his fourth free trip to California, and the third one funded by Ohio citizens,” Doss said.
Ann Stevens, spokesperson for Montgomery County Children Services, said that the county is complying with orders from Juvenile Court. “In these difficult economic times, it’s not uncommon for parental visits to take place out of town,” she said. “People need to keep in mind that Mr. Mills is still legally this child’s father.”

Dear Editor:
I am writing in response to the article that was published on (July 12, 2010 of the Local Buzz,) and (July 16, 2010 of the Lamar Ledger). “Article on Promoting Responsible Fatherhood.” As a responsible and loving parent and a member of this community, I was deeply concerned and somewhat offended by this article.  I felt that there were many misrepresentations of facts and this editorial came across as very biased. 


I feel that such an article serves only to further divide not only our community but our Nation that prides itself on families.  I feel that since media hold an enormous amount of power when it comes to influencing people on so many levels, I feel it becomes all the more important that when there is such blatant divisions between genders, the responsible thing to occur would be investigative reporting. This would serve two purposes to society;
  1. It balances rather than compound the problems that are dividing our nation and communities like that of gender wars putting fathers against mothers and,
  2. It challenges outdated myths and societal perceptions. Such as:
Myth -- Research on single mother households proves that "fatherlessness" harms children.
Fact: "[F]ather absence does not significantly influence the level of well-being of either daughters or sons. Rather... children's perceptions of their relationships with both parents have a more direct influence on their psychological well-being than does the physical presence or absence of their father."
Myth -- Boys need fathers in order to learn how to be good husbands and fathers.
Fact: "Most boys who grew up with single mothers have positive opinions of them.  They are likely to have 'experienced' the process of disassociation from women much less strongly than boys from father-mother households.  An overwhelming number of boys and men under thirty who like and admire their mother are those who grew up, for most of their childhood years, with their mother as the sole head of the household... growing up to have better relationships with women.  They are usually freer in conversational style, listen with more interest to what women say, and see women as individuals first rather than 'women' first.  In short, they are more comfortable with women, and identify much more, not afraid of solidarity with a woman, or of trusting her.

These are only a few myths that were relayed in your article.  I am attaching additional ones with this correspondence for your review.
As a Nation, we should not be trying to focus on just fathers or just mothers but us as parents.  Both genders should have equal access to "responsible PARENTING" programs and both male and females should be able to attend together so that balance is present.  This article gives mothers such little credit and almost appears to have a hidden agenda.  Who is to say that a single mother cannot raise a successful and responsible citizen absent a father?  FATHERLESS CHILDREN STORIES
The lead article in the February issue of Journal of Marriage and Family challenges the idea that “fatherless” children are necessarily at a disadvantage or that men provide a different, indispensable set of parenting skills than women. 
"The presumption that children need both a mother and a father is widespread. It has been used by proponents of Proposition 8 to argue against same-sex marriage and to uphold a ban on same-sex adoption." Furthermore “Significant policy decisions have been swayed by the misconception across party lines that children need both a mother and a father.


Yet, there is almost no social science research to support this claim. One problem is that proponents of this view routinely ignore research on same-gender parents,” said sociologist Timothy Biblarz of the USC College of Letters, Arts and Sciences.
Stacey concluded: “The family type that is best for children is one that has responsible, committed, stable parenting. Two parents are, on average, better than one, but one really good parent is better than two not-so-good ones. Barry Goldstein, Co-chair of the child custody task force of NOMAS the National Organization for Men against Sexism. Domestic violence expert, speaker, writer, consultant  co-editor of newly released book DOMESTIC VIOLENCE, ABUSE and CHILD CUSTODY says it best when he states (via-email):

“To me responsible fatherhood would be men supporting protective mothers and seeking to hold abusers accountable.”

What needs to be brought to light is the real initiative to this and what statistics say regarding Fatherhood. Remembering when I was a child and the role of a father, or DAD.. There were no paid programs to make fathers be good dads. Why? Because it (Fatherhood) like motherhood, is a natural action of a GOOD Father, and does not need classes to learn how to be responsible. The concern that all should have with this program is;
  1. The money that is being used to pay for it.
  2. Making someone do something they may not have to desire to do, can be harmful to the child.
  3. The main focus is on Fathers, not on helping parents as a whole.
  4. The failure to include all studies.
Perhaps, having all the information at hand would better serve not just the Father’s but the community as a whole. For that is a lot of money being given to just a selective few.
A few that has already shown, no desire of being a good parent otherwise this bias program would not be initiated.  
As the old saying goes, "you can lead a horse to water but you can't make him drink" applies also to the attendance of such programs.  I think that this community and our Nation have to bring the focus back to responsible parenting and not dividing the genders to make war.  There are no benefits for our children in this as our family courts are being flooded by such "responsible fathers" and the children are being destroyed because our government is pushing such programs.

Grant helps fathers stay in kids` lives

Fatherhood goes quite a way back for Anthony LaTour with the Prowers County Department of Social Services. "It goes all the way back to 1994 when I found out I was going to be a father at the age of 16," LaTour said.
LaTour, who works with Special Programs for Social Services, said organizations in El Paso County helped him with learning how to be a good father.
Professionally speaking, LaTour said fatherhood has always been a passion of his and he wants to help other fathers become the best parents they can be.
"I lost both my parents. I lost my mom when I was 15 and I lost my dad when I was 12," LaTour said.
At a crucial time in his life, he really needed support and needed a father figure to help him make positive choices, he said.
He found that support in his high school basketball coach and English teacher, Bruce Bradshaw.
Bradshaw helped him academically, telling LaTour that although he was a decent basketball player, he still needed to keep his grades up, same as the other students.
"Those small lessons, it was contageous throughout my life," LaTour said. "To be able to start a program like this, in Prowers County, it means the world to me."
Other people were vital in his life, he said, and when he arrived in Prowers County 15 years ago, he was unsure where he was going to go in life.
It was important to stay in college, he said and the community has supported him and his family since they arrived.
His wife`s family is from Prowers County, he said and working at Social Services and with Crossroads and helping fathers become better and more active in the lives of their children has been an honor.
"I feel privileged to be able to give back in this way," LaTour said.
Several people at Lamar Community College made impressions on him and helped him, he said, furthering the desire to give back.

Now, with a grant from the Colorado Department of Human Services, Colorado Works Division for $40,000, there are going to be two programs, one of which is the nurturing fathers program and the other is responsible fatherhood development.


"What both programs are going to accomplish is bringing in the average dad, starting him on a 12 week program and at the end of those 12 weeks, the dad will have the tools that he needs to be a successful father in his child`s life," LaTour said.
The classes will meet one day a week for two hours, hopefully off site from Social Services, he said.
Mentoring will also be offered for fathers, he said, beginning after the classes start.
Fathers who have become engaged in their child`s life will be coming back to help other fathers to learn.
The classes will change the social norm of being a father, moving from fathers who say they can throw something on the grill and talk about sports or other issues to fathers who are more engaged.
"We`re moving towards let`s talk about being a dad. How can we be a good dad," LaTour said.
Every child needs a different type of father, LaTour said."But only that father can be that connection to that child," he said.
The program will be part of the child support enforcement unit, but will not be a court ordered program, LaTour said.
Programs such as Watch D.O.G.S. have been started in Granada and LaTour hopes to expand the program to other schools.
Fathers are able to take part in the lives of their children and attend school functions through the Watch D.O.G.S. program and LaTour said the participation in Granada schools has been great so far.
The program started last winter and LaTour hopes to have more fathers take part this coming school year.
