Domestic Violence Continued: Contested Child Custody

DES MOINES, Iowa -- A man convicted of killing his estranged wife said Friday at his sentencing that he has no remorse for her death, and he hopes that it happens more and more.

Exactly one year ago Thursday, a hostage situation in Des Moines ended with TereseAnn Lynch Moore dead and a police officer injured.

Randall Moore was convicted of kidnapping and killing TereseAnn Lynch Moore. Randall Moore also shot Des Moines officer Todd Roland.

Moore was sentenced to three consecutive life sentences for TereseAnn's death and 25 years in prison for shooting Roland.

From Moore throwing insults at his victim's mother to Moore's several minute tirade in court to a fight over TereseAnn Lynch Moore's childhood pictures, which Moore said should burn in hell, court experts said the sentencing was unprecedented.

But then, veteran Judge Joel Novak got a turn to talk. Novak told Moore that it's not TereseAnn's personal belongings burning in hell Moore should be concerned with.

Novak told the court that "if anybody didn't know what a piece of work you are before this sentencing, they know now."

"The court doesn't allow me to punish you any more than I'm doing now. If I could, I would," said Novak.

Before the sentencing, Moore and family members had a chance to read victim impact statements. Moore spoke for close to 11 minutes.

"I'll tell you point blank, I have not once ounce of remorse for TereseAnn's death. It could have all been prevented. All you had to do was let me see my kid. Now you're never going to see her again.

"You give me every single item you took back from my property and I might consider giving them back. If not, they can burn in hell. I don't care. You'll never see them again.

"I want to apologize to Todd Roland for shooting him. You know that day when you were laying on the ground behind the police car, Todd, I could have killed you. I could have shot you 25 times. I chose not to. Because you didn't pull your weapon on me. If you would have pulled your weapon on me, I'd have been her for another murder charge.

"I hope there's more cases just like this where people that don't want to let their spouse see their kids, I hope it happens more and more

"I had several no contact orders on me and you know what the funny thing is? The day after a no-contact order was put on me, that girl was laying in my bed with me. So she wasn't too worried about anything, it was just something to get a piece of paper to get me away, but then they always came back.

"The only thing I've ever done is push a woman in my life. You can think what you want, but that's my side of the story and I'm sticking to it."

"There's certain lines that a judge should not cross in terms of judicial propriety. I've always tried to live by that rule. And sometimes you just have to throw caution to the wind. And if I do cross that line today, I'm willing to cross it and pay the consequences.

"Let me start off by saying if anything should burn in hell, it's not TereseAnn's yearbooks.

Novak talked about two other murder cases he has tried, including one on I-235 and a strangling case. "You three have so much in common. I can't believe it. Yeah, shake your head because you know you do."

"I can't believe what I've heard, but I'm really glad you had your right of allocution and you could say everything you said because if anybody didn't know what a piece of work you were before you started talking, they know it now.

"It's been said before and it can't be said enough. You're cowards. You truly are cowards. You prey on women, they give you their love. They give you their trust and you betray them. You betray it by physically and or mentally abusing these women and they stay with you.

"You guys can't understand why they leave such wonderful men, like you.

"You give a new meaning to the word evil.

"I've been doing this 31 years. I've never ever seen anybody like you. And I hope I never ever see anyone like you again.

"It means joined or attached. Now isn't that something? Because you've made sure that Levi can't be joined or attached to his mother again.

"I'm going to tell you something. I really would have to think that the Good Lord looks at somebody like you and has to say to himself 'Maybe there should be some exception to forgiveness and redemption for somebody like you.'"

Once Randall Moore was sentenced to three consecutive life sentences, TereseAnn's mother, Sheila Lynch, told KCCI the blunt words from the judge were awesome.

"What you did to my daughter, TereseAnn Marie Lynch was evil, hateful and despicable. You couldn't destroy her spirit, so you took her life instead.

"Your evil, dark and disgusting persona could not stand to see her free and happy and so you brutally murdered her.

"There is no way to convey how much TereseAnn is missed, but she lives on in the hearts of her family and her friends and her son.

"You, on the other hand, will always represent the evil that I previously only guessed must be in this world.

"You are evil, hateful and disgusting. You are now dead and rotting and repulsive to me, but with timing and with God's help and with the help of TereseAnn's loving spirit, soon you will be absolutely nothing to me. I hope you forever remember the difference between TereseAnn and you."

"I'm OK, I'm more OK now than I think I have ever been through this entire process. It was better than I could have even hoped or dreamed for. Everyone got to say what they wanted to say including him and all he did was bury himself with what he said. He's going to be gone and that's what we want, more than anything. He's going to be gone and my daughter's going to live on in our hearts, in our memories and in our love for her. And he's going to be gone," said Sheila Lynch.

"The only thing that can be better is to do more for future domestic abuse victims. To have things in place that will help them more than the help that my daughter got at the time she needed it," said Sheila Lynch.

"He's very full of himself and you saw not one bit of remorse there. In fact, really arrogance toward the court and toward the whole process," said John Sarcone, Polk County Attorney. "He hasn't changed."

"A couple of times I wanted to laugh at the arrogance, at the stupidity," said Sheila Lynch.

"I shouldn't have been surprised. I know how arrogant he is. But the shock of what he could actually sit there and say and think that he's justifying what he did was amazing to me. He could say nothing worse than what he did to her. No words can be worse than what he did. He hung himself. I didn't have to do it for him," said Sheila Lynch.

"My daughter touched so many lives and in a way she also touched the judge," said Sheila Lynch. "The judge showed the humanity that all of us felt but he said it straight and directly from the legal system's point of view and it was wonderful."

The courtroom was filled and about a dozen deputies were present during the sentencing.

November 11, 2010 by Elizabeth Black · This week, Arianna Huffington announced the Huffington Post’s latest section: HuffPost Divorce. Her plug: “Breaking up is hard to do… but reading about it isn’t.” Upon Monday’s launch, however, there appeared a column that women’s rights advocates took very hard: a piece by Dr. Richard Warshak promoting the discredited “Parental Alienation Syndrome,” or PAS.

Parental alienation is a dangerous custody-battle concept that has been used primarily against mothers–and in particular, mothers trying to protect themselves and their children from hostile or abusive ex-partners and fathers. As R. Dianne Bartlow explained in her Summer 2010 Ms.article, “There’s Nothing Friendly About Abuse”:

PAS theorizes that most accusations of child abuse (especially sexual abuse) made during a custody battle are actually fraudulent. Not only are the charges false, says the theory, but they are deliberately undertaken by one parent (in most cases, the mother) to “alienate” the child from the other parent (generally, the father).

Frighteningly, PAS has allowed abusive or otherwise hostile fathers to gain custody of their children and then forbid the children contact with their mothers.

Yet parental alienation is not accepted as a valid theory by the American Psychological Association, and was rejected from the DSM-V. Without a real psychological definition, it has devolved over the years into a label for any negative testimony about the father by the mother (even if it’s true). It’s also now promoted as gender-neutral, but the parent most often labeled the “alienator” remains the mother. It’s also one hell of a cash cow for psychologists who make a living from it.

In keeping with all this, Warshak’s post, “Stop Divorce Poison”, gives an overly simplified description of “alienation” that could describe nearly any hostile or cantankerous relationship: “persistent bad-mouthing, lies, exaggerations, overlooking positives, and drum-beating negatives.”

A half dozen domestic violence and motherhood activists, including myself, descended upon Warshak’s column to leave comments describing how discredited PAS really is. But, as I witnessed and others report, by the evening of November 9, most of the comments (nearly a dozen) posted by critics had been deleted in the space of five minutes. According to those I’ve spoken with, deleted comments contained valid source material from professional organizations citing:

  • how discredited parental alienation really is
  • how parental alienation did not make it into the DSM-V
  • how it is used primarily as a weapon by abusive fathers against protective mothers

Another activist and I wrote to David Flumenbaum and Arianna Huffington to inform them about the censorship of opposing, critical views. Both of us received an email in return from Social News Editor Adam Clark Estes, who wrote:

When considering the above screenshots (pure facts devoid of non-objective commentary) it’s unclear which part of these guidelines apply:

(I) The Huffington Post welcomes all users to join our community and to comment and treats all members of the community equally.

(II) We want the Huffington Post to be home to open, transparent conversations in which people connect, discuss, share ideas, and debate the issues.

(III) We are also committed to maintaining a non-toxic atmosphere.

(IV) In order to preserve a functional and civil conversation, we do not allow trolls, trollish behavior, or stalking.

(V) Members of the HuffPost community deserve to be free from spam, and we do not allow posting the same comment multiple times within one thread or on multiple threads.

It’s frustrating that the supposedly progressive HuffPost has given a platform to Dr. Richard Warshak, one of parental alienation’s most fervent supporters, but won’t give the same platform to its commenters.

On November 10, activists returned to the article to comment; it remains to be seen if their comments will be deleted–or whether they’ll fall victim to HuffPost-moderation’s thin skin. If a blog can delete comments opposing their viewpoint, then what’s the point of comments? You might as well change the name to “compliments.”

Maybe this should come as no surprise. From what I'm learning, Huffington Post doesn't care much about scientific facts or freedom of speech. Check this out on Digg. An update to our previous 76 Killer Dads and 88 Killer Dads lists.

This is not a comprehensive list of all U.S. fathers who have killed their children in situations involving domestic violence and/or child abuse. This list is limited to articles I have found personally where there was an identifiable child custody, visitation, and/or child support angle in the children's deaths. Even then, I can’t claim that this is a comprehensive list of child custody, visitation, and or child-support- related murders. Quite often, newspaper articles just don’t provide enough information to make a judgment call.

There is no time limit to the actual dates of death on this list, though most are comparatively recent— usually (but not always) with an article on the deaths appearing in the last year or two. (Often it takes years for charges to get filed in these cases, or for cases to go to trial.) However, there are references to a few cases going back to the 1990s.

Feel free to use this as a data base for additional research or to narrow the deaths down to the time period and/or geographic setting of your choosing.

The mother contacted the Tucson police regarding her custody order, and they refused to retrieve the children. Within months the children are dead (exact date unknown, only one body was found). Mother sues City of Tucson CPS, and they settled for $1 million in June 2008. In October 2010, Judge Carmine Cornello dismissed mother’s suit against the police.

Father filed for custody in November 2008, obtained it in February 2009. Child was apparently sexually abused, battered, and tortured from the start. In April 2010, father pleaded no contest to 1st-degree murder, and sentenced to life in prison.

Mother had unsuccessfully petitioned for protection. Article from November 2010 mentions that surviving mother Jennie Carter is now an advocate for victims of domestic violence.

Behind the closed doors of the dirty little secret of the family court system, thousands of women each year lose child custody to violent men who beat and abuse Mothers and Children. Family courts are not family-friendly and betray the best interests of the child.

(11-10) 16:17 PST SAN DIEGO -- A state commission accepted the resignation Wednesday of a San Diego judge who auditioned for a reality-TV program in her courtroom, led spectators in "woo-woo" chants, and told a defendant that if he violated probation, "you will definitely be screwed and we don't offer Vaseline for that."

The Commission on Judicial Performance censured Superior Court Judge DeAnn Salcido on the condition that she leave the bench. The commission said she had committed 39 acts of misconduct.

Salcido has expressed regret for the "Vaseline" remark and a few other actions, but issued an unapologetic statement Wednesday saying there were "certain perceptions of my style that made it prudent for me to move on."

"Humor and less formality in certain courtroom contexts can be very effective," Salcido said. Her comments were intended to "connect with the offenders, the victims and others in the courtroom," she said.

Salcido, 45, a former prosecutor and business lawyer, was appointed to the bench by Gov. Gray Davis in 2002. She was elected to a new six-year term in June, when she was one of four San Diego judges unsuccessfully challenged by conservative Christian lawyers. The commission made its charges public in September.

Salcido acknowledged allowing a local television producer, who was looking into a possible "Judge Judy"-type show, to film a day of proceedings in her court in May 2009. The commission said Salcido had agreed to "line up my most interesting cases" for that day and appeared to be playing to the cameras.

Referring to one defendant's positive test for marijuana, she asked the audience, "Can I get a woo, woo, woo?"

She later led the spectators in a chant of, "Do or do not, there is no try," asked another defendant that day if he needed to "call the lifeline" about a sentencing choice, and told a defendant he would be "screwed" without Vaseline if jailed for a probation violation, the commission said.

In another case that day, the commission said, Salcido noted that a defendant was smiling, and told him, "They might like your smile in jail." She later told the commission she regretted the comment.

Salcido also disparaged other court personnel, the commission said. She referred to a fellow judge as "assistant public defender" and described court clerks several times as "cucumbers."

The commission said judicial humor "should never be used in a courtroom, as it was by Judge Salcido, to ridicule, embarrass or disparage others, or in a manner that diminishes the dignity of the judicial process."

THE HUFFINGTON POST AND DR. RICHARD WARSHAK: SUPPORTING CHILD ABUSERS THROUGH CENSORSHIP

Everyone knows that the concept of “parental alienation” will not be in the new Diagnostic and Statistical Manual of Mental Disorders (DSM-5), but this hasn’t thwarted those who make a handsome income off of it.  Dr. Richard Warshak, who sells his testimony and services treating “parental alienation” in child custody cases, has apparently bought or scammed his way onto The Huffington Post and is not allowing comments on how others, including professional organizations, look at this excuse for protecting abusive parents.  I, along with several other domestic violence advocates, posted comments on The Huffington Post in response to a new post by Warshak that touts his professional bread-and-butter, and they were apparently dropped in their bit bucket.  Here is my first comment:

Many professional organizations recognize that claims of so-called “parental alienation” are used by abusive spouses to gain custody of children from their victims.  Some of these organizations include the American Judges Association, the National District Attorney’s Association, the American Bar Association, and the National Council of Juvenile and Family Court Judges, with the latter warning family court judges not to accept claims of “parental alienation” or “parental alienation syndrome” because of it’s well know use by abusers.  Research has shown that the number one reason children refuse to visit a parent is because of the behavior of that parent.  Stop putting children in danger by placing them with the abuser.  Dr. Warshak and others that push this so-called disorder make a lot of money selling their testimony in this family court scam.  I would think The Huffington Post was above promoting such snake oil salesmen.

As of the morning after Warshak’s post appeared on The Huffington Post, there were twelve hand-picked comments on the post, which includes one by Warshak cheerleader “Monika” who is Monika Logan, a big “parental alienation” supporter in Texas.  She is a regular commenter on stories that push this scam.  Her blog supports these people who make lots of money off of promoting this “judicial tool of abuse.”

Warshak was involved in a case recently in Canada, in which he testified that two boys apparently “poisoned” by “parental alienation” would benefit being treated at his “treatment center,” a center that charges $40,000 per four day session.  The recommendation was so ordered, but overturned in appeal because Warshak admitted that he had only interviewed the parent claiming “parental alienation” and not the other parent.  Warshak failed to even interview the boys when he recommended them for his unproven program.  Seems $40,000 is quite an incentive to recommend something to someone he hasn’t even seen.

Shame on The Huffington Post to allow these quacks and their supporters space to sell their wares, because that is exactly what they are doing.  Then again, The Huffington Post has a history of censorship.  So be careful what you read even if you think it is a respectable site.  Apparently everyone has their price, and there’s a lot to be made in the “parental alienation” jackpot.

Rikki is often on my mind.  Granted, not as much as on her mother, Claudine Dombrowski’s, mind.  I was also a child victim of family courts, just as Rikki is.  Just as my children are now, although I don’t write about them at all (too traumatic).

Rikki was taken to talk to the judge (alone, no witnesses), Judge David Debenham, a couple of weeks ago, while her mother Claudine was in the midst of another judicial smackdown.  Although she had been given the right to see her daughter after years of no or limited (supervised) contact in the January 2010 hearing that I attended as a court watcher, daddy Hal Richardson did everything in his power to not allow the visits to take place.  He had 83 violations of the court order up to a point this fall…read about the case here.

Witnesses have told me that when daddy Hal Richardson brought Rikki to be interviewed by the judge, he was acting very sternly towards her, and she was crying just before going in. Knowing that the last time Rikki was “allowed” to call her mother this past spring to cancel her two hour Sunday visitation, daddy Hall Richardson was yelling at Rikki in the background and Rikki was uncontrollably crying while she was telling Claudine she couldn’t see her that day.  That was the last phone call to take place.

My point is Rikki is one of many children in a situation like this, threatened to follow the abuser’s script or face the consequences.  In Rikki’s case, there is a child’s coffin in Hal Richardson’s living room ready for use.  If the corrupt court officials in this case actually did their jobs, Richardson would be in prison and Rikki would be with her mother.  There is a movement now to disbar Rene NethertonM. Jill Dykes lunged at Claudine in the courthouse hallway, and had her husband call to threaten her…actions will be filed on this also.   Snorting Topeka attorney Jason P. Hoffman continues to lie in court about anything to help his abusive client Hal Richardson, including claiming Claudine Dombrowski is me when he knows she is not.   No, Rikki Dombrowski is a cash cow to them.

Children like this are often a big source of income to people like this.  Snorting Jason L. Hoffman used the term “parental alienation” so much during the January 2010 hearing, I lost count.  This term, and syndromes/disorders associated with it, were invented by people (like Dr. William Bernet) who make lots of money from it, using it to sell books and sell their “testimony.”  It is well known by judge’s associations as a tool for abusers to get custody of children.  It certainly worked in this case…imbecile Judge Debenham fell for it (or maybe was paid off).

When I think of Rikki getting threatened in the courthouse hallway and her crying, I get really mad.  This is what our children are going through.  When will it stop?  The White House addressed family court cases during it’s press conference somewhat due to this case (after all they have beenreading about it here), but when is something actually going to be done?
