Gerald Picolla, a college sophomore in Albany, was out clubbing one night last November when he met another student and gave her his cellphone number.

“Within a couple of days, I started to see some red flags that this was not a girl that would work for me,” said Mr. Picolla, 20. “I tried to let this go as painlessly as possible,” he added, but “she literally started calling my phone 80 or 90 times a day with a restricted number.”

To end the onslaught of calls, he turned to a new service, TrapCall, that unmasks the telephone number and name behind an anonymous call, and, in some cases, provides the caller’s address. It also allowed Mr. Picolla to put the number on a “do not receive” list, which gives the caller a message saying the number they have called is no longer in service.

Almost since the dawn of the telephone, people have sought to avoid the unwelcome caller, relying on technologies from the answering machine to caller ID. But pranksters, harassers, bill collectors and telemarketers have found ways to circumvent caller ID by hiding their identities — listing a telephone number as “private caller” or “restricted” with their phone company.

Now, new services are aiming to outfox anonymous callers.

TrapCall, offered by TelTech Systems Inc., based in New Jersey, diverts an anonymous call to an 800 number, and then discloses the incoming number and name to the intended recipient, said Meir Cohen, president and co-founder of the company. The caller hears a normal ring tone and is unaware that the call is being traced to its source.

In the four weeks since TrapCall was introduced, 200,000 people have registered for the service, which is free.

Another free service called Google Voice, which will make its national debut in a few weeks, offers a similar service. Callers from those numbers will hear a recording, similar to TrapCall’s, saying the number is no longer in service.

TrapCall was initially available to AT&T and T-Mobile users, and is now available toVerizon Wireless customers. The billing names and addresses come from commercial databases.

James Harrington, who runs a media campaign company in St. Simons Island, Ga., said that while the service was handy in screening for telemarketers’ calls, he had a more pressing reason for signing on: to keep track of his elderly mother in Florida.

Mr. Harrington signed up for a paid variation of the service that allows voice mail messages to be transcribed into text messages.

“Now I don’t have to wait until a two-hour meeting is over to listen to my voice mail,” he said. “I can just look down at my phone, read the text transcription and know whether it’s something I need to deal with right away.”

That is important to him, he said, because he was in a court hearing when his father died in 1996 and was unable to take the call.

Gina Tran, 19, a hotel concierge in Los Angeles who gets up at 6 a.m., said she had turned to TrapCall after repeated calls from anonymous numbers. “My sleep was always being interrupted,” she said.

After receiving 21 such calls one night, she recognized the number that TrapCall revealed to her as that of a casual acquaintance in New York City. She sent him a text message to ask him to stop calling. He did, but resolving who is behind masked calls is not always so clear cut.

In domestic abuse cases, the victims, who often remain in contact with former partners for child custody arrangements, do not want the abusers using TrapCall to reveal their phone numbers and names and be able to track them down, said Cindy Southworth, director of the Safety Net Project at the National Network to End Domestic Violence, based in Washington, D.C.

The group is not taking a stand on the service, she said, but added: “We recommend using a third party, such as a friend or family member, as a contact point. That’s a way to be certain that one service can’t cancel out another, and the number really is blocked.”

Deidri Fishel, a domestic violence detective for the police department in State College, Pa., said a service like TrapCall could help find unwanted callers more quickly.

“We have so many cases where callers are using things like prepaid phone cards, where it can be cumbersome to track them,” she said.

In a twist, TelTech also offers a way out of TrapCall for those intent on keeping their phone number and name hidden. Called Spoofcard, the service allows callers to buy a false outbound phone number for a certain period of time that appears on the recipient’s caller ID screen.

Even so, people plagued by unknown callers may be able to use TrapCall to trace the perpetrator before he or she knows it, said Alexis A. Moore of El Dorado, Calif., who founded the nonprofit crime victims’ organization Survivors in Action after years of receiving untraceable phone calls.

“Most victims I have spoken with already are changing their phone plans so they will be able to use the technology,” she said.

“If it’s not easy,” she added, “most people doing that kind of calling won’t continue it.”

Not only can men murder their wives, they can dictate where the children will live:

Murder suspect wants to place kids

A Fayette County man accused of running over over his wife with his car and killing her wants his parents to have legal custody of two of his children.

In addition, Ronald Lee Higinbotham wants the cousins of a third adopted child to have custody of that youngster.

Higinbotham, 44, of Brownsville, is charged by state police with criminal homicide in the hit-and-run death of his wife, 30-year-old Carmen Higinbotham.

In a criminal complaint, state police allege Higinbotham drove his 2000 Hyundai Tiburon over his wife shortly before midnight June 20 on Route 40 near 7235 National Pike, then left her to die.

Carmen Higinbotham was the mother of six children, including two of her own, two stepchildren and two who were adopted.

According to separate civil actions scheduled to be presented in Fayette County motions court today, Ron Higinbotham is the natural father of two of the children – a 9-year-old girl and a 6-year-old boy. He is the adoptive father of a third child, identified as a 15-year-old boy.

The two younger children are staying in West Brownsville with Ron Higinbotham’s parents, Patricia Ann and Donald Lee Higinbotham Sr., according to one of the filings.

In a separate civil action, Higinbotham wants a judge to grant custody of the adopted 15-year-old boy to the boy’s cousins. The boy’s cousins, Eric W. and Maxine R. Rosie, of Smithfield, already are caring for the teen, according to the civil filing.

Attached to both filings are custody agreements, both of which have been agreed to and signed by Ron Higinbotham.

He remains lodged in the Fayette County Prison without bond. He faces a preliminary hearing scheduled for 9 a.m. Aug. 28 before South Union Township District Judge Joseph George Jr.

We need help here, as it seems no one really cares that these kids’ mother died from his carelessness.”

Grandparents adopt Elijah after long Hawaii court fights with killer

After a nearly four-year battle in Hawai’i courts, Minnesota residents Steve and Donna LaDuke finally and officially can call Elijah, 5, their son.

The many hurdles the LaDukes overcame to adopt their grandson following the 2005 murder of his mother exposed a huge gap in the judicial and child-custody system here and nationally, the couple said.

In cases where one parent murders another, they said, the legal process is set up mainly to protect the killer’s parental rights, even at the expense of the children.

How much more proof do we need before we reform family court?!?

In this corner, we have “failure to report,” a situation where a person fails to report child abuse.  The person can be fined or jailed.

And in this corner, we have “false allegations,” a charge that a person (women are often to blame) makes a malicously false allegation (to see how popular this is, google “false allegations” and see all the fathers’ rights sites pop up).  A person can be fined, jailed or lose custody over a supposedly “false” allegation.

CPS: Child beating victim in very serious condition

JASPER COUNTY - Investigators say the father of a 5-year-old boy chased him around the yard with a chainsaw after beating him so severely the youngster is now in very critical condition at a hospital.

The child’s father, John Cornelius, 24, is charged with Injury to a Child and jailed on a $500,000 bond. Cornelius’ girlfriend, Jessie Waddell, and her mother, Wanda Macks, 54, are charged with Injury to a Child and Failure to Report an injury.  Their bonds are a total of $140,000 each.

Waddell isn’t the boy’s biological mother.

Shari Pulliam with Child Protective Services says Waddell and Macks told investigators Cornelius chased his 5-year-old son around the yard with a chainsaw last weekend because he was mad the child complained that his leg hurt after he was beaten.

The boy had surgery Wednesday night and underwent a third operation Thursday afternoon at a Houston hospital. Pulliam says he’s in critical condition and adjusting to a ventilator.

Pulliam says the boy has a MRSA staph infection which began in his leg and spread throughout his body.

Judge dismisses abuse allegations

In the last two years, Nicole Vanosdel has made at least three reports of alleged sex abuse involving her ex-husband. The reports included allegations of touching, kissing and fondling alleged by their daughter, the mother said.

Each time, Iowa’s Department of Human Services has not found enough evidence to confirm, or found, the girl’s accounts, Nicole Vanosdel said.

On Friday, the girl called 911 again, alleging she had suffered abuse – but not that night. She was questioned, examined at a hospital and placed in Children’s Square shelter with about 10 other children.

She remained at the shelter until Wednesday, when her mother, the primary custodial parent, was allowed to pick her up. Vanosdel said she has a 15-year-old daughter from another relationship, and she has no problems allowing the teen to visit her father.

Child abuse experts said Wednesday that most allegations of sex abuse wind up not being prosecuted for lack of evidence.

“Often, all you have is the child’s word,” said Donita Faust, a licensed social worker and forensic interviewer for the regional children’s protection center at Blank Children’s Hospital in Des Moines.

However, Faust and other experts said young children rarely lie about such things. And it’s extremely rare for young children to lie consistently about sex abuse.

Can’t we sue judges for “failure to prosecute”?!

Why don’t we believe the children?!  The father countered her claim of sexual abuse with the pseudo-scientific claim of parental alienation syndrome (PAS). PAS has been discredited by the American Medical Association, the American Psychological Association, and the American Prosecutors Research Institute and the National Council of Juvenile and Family Court Judges. YET THIS JUDGE BELIEVES THE FATHER’S CLAIM OF PAS AND NOT THE CHILD’S CLAIM OF SEXUAL ABUSE. 

Failure to report vs. false allegations have put women between a rock and hard place, especially in family court. Don’t report abuse and you can be fined or jailed. Report abuse and get branded a liar – moreover, you can be fined, jailed or lose custody for making a “false” allegation of abuse. That means your child will live with the person who is allegedly abusing him or her. Laws that punish people for “false allegations” are on the rise due to many fathers’ rights groups lobbying efforts. Punishment deters reporting. One has to wonder why fathers would want to punish people for making abuse allegations – doesn’t sound very fatherly to me, does it to you?

Amy Leichtenberg quietly approached the casino boat gamblers with fliers, hoping they may have seen her ex-husband, a known gambler. Three weeks earlier, he abducted the couple’s two young sons and by now all other leads had come up snake eyes. Then her phone rang.

An investigator on the case told her to drive to the McLean County Sheriff’s Department to discuss something new in the case.

Leichtenberg excitedly made the two-hour drive to the police station, allowing herself to daydream about her two boys—9-year-old Duncan and 7-year-old Jack—happily greeting her there.

Inside the station, she didn’t see her boys waiting for her. Instead, Beth Kimmerling, the county coroner, introduced herself.

"No!" Leichtenberg screamed, quickly realizing her hopeful daydream turned into her worst nightmare. "No! No! No!"

The coroner couldn’t even get the words out, telling Leichtenberg that Duncan and Jack—the joys of her life—were dead. And her ex-husband was dead, too, taking his own life after killing both his sons.

"Where are my babies?!" Leichtenberg remembers asking frantically through sobs. "Where are my babies?!" The coroner told her the boys’ bodies were with their father’s body in the back of the police station.

"I want my boys as far away from him as possible!" Leichtenberg remembers yelling, punching a desk and nearby concrete walls.

As the coroner left, Leichtenberg dissolved into a chair, crying, screaming and shaking. She felt numb. She felt empty. She felt like joining her sons in heaven. "I want to see my babies," she remembers telling authorities. No, they told her. Not yet. Not now. Not in their condition.
She begged them. They refused.

“My child and I have been threatened and intimidated by the possibility that I may go to jail and be held in contempt due to my child refusing to have visitation with her abusive father and she may go to foster care.” Her father has told her this over and over again, as well as Judge David Miron.

This is not the first time that this mother has had to protect her child from the father. Oconto County CPS did substantiate sexual abuse allegations against the the father, he found a loop hole and had the recused Family Court Commissioner, Frank M. Calvert unsubstantiated the sexual abuse allegations.

The system has failed my child, from Oconto County and its CPS worker, Carrie Silbernagel-Burke to Marinette County Circuit Court Judge, David Miron.

This father does not have the means to care for her. She has no bed or a bedroom due to the fact he lives with his mother who only has two bedrooms.

The 11 yr old child is given the choice to sleep either on the floor in the living room or down in the basement. She has no privacy or space to call her own while she is in her fathers care. She is continually tormented and tortured by both her paternal grandmother and father, this is nothing new.

This child has been exposed to domestic violence by her father towards her mother several times. She was also a passenger in his car when he was arrested for driving drunk in the middle of the day. The CPS worker, Carrie Silbernagel-Burke told the mother:

“drinking and driving with his daughter did not make him a bad father, he made a bad choice.”

This was nothing compared to the sexual abuse my child endured and other court ordered abuse.

My child has taken her stand against her abuser, the court ordered abuse and threats of foster care by Judge David Miron.

My child is not an empty vessel, she KNOWS where she is safe. She has not lied to social workers, even with her father prodding her to.

All her needs are provided by her loving Mother and she knows that

“I am not going to shut up, give up or go away!”

“My only wish is for my daughter to be safe and sane.”

If this mother is jailed for doing what any mother would do for her child

the consequences to my accusers and judges will be as follows.

There will be a hunger strike (Troscadh), and all the battles up until now were training for we intend tow in the war and expose the dirty little secrets of family court and the criminals that run it.
