Dr. Roy W. Bradbury

Wow, just like Janelle Burrill, this guy couldn’t pass the licensure test for psychologists in California.  I’ve heard about this corrupt, biased California custody evaluator for a while.  He offed himself, just like Dr. Richard Gardner did.  Is it because he started getting a heart and couldn’t take what he did to all the children and families he’s harmed?  Or was it he was being zeroed in on for his corrupt activities in family court?  Who knows, but he’s likely to be one of those people you’ll see in hell.

From The San Bernadino County Sentinel (8/6/10):

Suicide Claims Dr. Roy W. Bradbury

The man who did psychological evaluations of children involved in divorce cases in San Bernardino, Los Angeles and Orange counties, guiding the courts in determining custody, and whose recommendations controlled the fate of thousands of individuals for over a decade took his own life earlier this year.

The death of Dr. Roy W. Bradbury, who was a court appointed expert for so-called 730 evaluations, has thrown into question the validity of the determinations that were made in hundreds of divorce cases in San Bernardino County.

Bradbury worked with lawyers, known as minor counsels, who were appointed by the court to represent children caught in the middle of the divorce of their parents.

Those minor counsels would recommend interviews with and reports on the children, known as 730 evaluations, to determine the child’s state of mind, preference toward one parent or the other and to make an evaluation as to which parent should get primary custody of the child.

For his work, Bradbury was paid $120 per hour, or in the neighborhood of $10,000 to $15,000 for each 730 evaluation he delivered.

In virtually all cases in which Bradbury was brought in as an expert witness, the court made a custody decision in accordance with his recommendations. Bradbury was deemed so credible, that judges routinely overlooked contradictory opinions rendered by other psychologists or evaluators brought in on the same cases.

For years, however, critics have alleged that Bradbury was capricious, arbitrary or biased in his findings and that he in fact lacked the requisite training and licensing to function in the role of an expert psychological witness.

Within the last 12 months, evidence to undergird those accusations emerged. In September 2009, according to court records, Bradbury admitted under oath that he had lacked the proper licensing updates with regard to domestic violence since 2003. Such a lack of credentials rendered him unqualified under the family law code to serve as an evaluator.

Despite Bradbury’s possession of a PhD. in psychology from USC, he was unable to pass the state of California’s licensing exam as a psychologist.

Earlier this year, as information about his lack of training and his fraudulent licensing spread, rumors were rife that Bradbury was on the verge of departing the United States and seeking some form of refuge in Costa Rica.

A little more than two months ago, he died by his own hand. His action in taking his own life brings into question his own mental stability, and by extension, the validity of the thousands of conclusions he provided about the mental state of others.

On Saturday May 29, according to the Los Angeles Coroner’s Office, Bradbury who resided in Walnut, drove to an industrial park in the city of Industry. There, at 21508 Ferrero Parkway, a spot secluded by railroad tracks and relatively isolated and remote buildings, Bradbury shot himself while in his vehicle.

According to the coroner’s office, Bradbury expired from a single gunshot wound to the head.

Two years ago, a website, http://courtlawabusers.blogspot.com/2008/11/dr-roy-bradbury.html, was set up for the purpose of chronicling complaints with regard to Bradbury. Since that time, questions about his level of competency, his bias and his tendency to make findings that were considered damaging to children have mushroomed. That adverse publicity may have played a role in the more recent revelations about his lack of accreditation.

Despite those revelations, San Bernardino County Superior Court has maintained Bradbury on its experts list for psychologists.

In one case, an eight year old girl was removed from the custody of her mother. Subsequently, tapes of Bradbury’s sessions with the girl surfaced in which Bradbury could be heard screaming at the child. One counseling professional who has heard the tapes told the Sentinel the tapes demonstrated Bradbury was mocking a child under stress and was not engaged in a therapeutic relationship with his client.

In the aftermath of his death, dozens of Bradbury’s 730 evaluations are due for consideration in various courts in Southern California. Motions to strike several of those evaluations as evidence are now being prepared.

Crisis in Family Court
No one wants to wind up in family court, but with over 50 percent of marriages failing, it’s a familiar place for thousands of parents. Dr. Phil shines a light on the American family court system and how often it fails its citizens. Concerned for her 9-month-old son’s safety, Katie pleaded with Judge Robert Lemkau to order supervised visits for her ex, Stephen, who was threatening to kill their son, Wyatt, and then himself. When she was told that the couple should work it out, Katie returned to court on four additional occasions, desperate for someone to believe Wyatt’s life was in danger. Tragically, despite her exhaustive efforts to protect her son, Stephen did exactly as he threatened. Will the judges be held accountable? And, protesters of Judge Lemkau’s re-election want their stories heard -- heartbreaking stories of how they say the family court system failed them. And, one teen speaks out on behalf of kids caught in the middle of custody battles and court rulings. At the hands of an abusive father, she says the court system ignored her pleas for help. Don’t miss this eye-opening show!

Failed by the System
Two months ago, Katie found herself pleading with a judge to order supervised visits for her ex, Stephen, and their 9-month-old son, Wyatt. When Stephen threatened to kill their son and himself, Katie tried multiple times to get a restraining order. After Katie’s five attempts to get protection from the court, Stephen did exactly as he threatened.

“They would both still be here if that judge would’ve just listened to me.”

The Aftermath
Katie explains what happened in the days that followed her son’s murder. She says someone else knew what her ex was going to do and failed to stop it. And, meet a man who says he’s going to stop Judge Lemkau from doing any more damage to people’s lives. Plus, meet others who are trying to educate the public about the U.S. family court system and how they say it needs a massive overhaul.
“They’re told they will lose custody of their children by reporting abuse.”

From a Child’s Perspective
“Stephanie,” 17, wanted to speak out on behalf of the kids in the middle of custody battles and court rulings. She says because courts have ignored cries of abuse, some kids are left in the hands of their abusive parent. Stephanie fears this is happening with her younger sister. And, meet another mom who says the court failed her and her two boys.
Plus, are court appointees profiting off of fractured families?

The Murder of Sheila Deviney "Oklahoma Style"

 Susan Murphy-Milano’s Journal

By Sheryl McCollum, Holly Hughes and Susan Murphy Milano

The murder of Sheila Deviney on January 6, 2004, was no accident. Sheila Deviney was in fact murdered! On Monday evening's show on "Intimate Partner Homicide Investigation" we were flooded with calls from friends, relatives, college professsors, co-workers, and former classmates providing vital information regarding the murder of this young woman.

Dozens of statements, now recorded in podcast, from callers on the show as to Sheila's fear, her statement of mind and the threats made against her life, including the day before the fire, were never investigated by authorities. So how the heck does a case go cold for so many years without an investigation, a named suspect or an arrest? The answer is clear. The state never investigated the murder. The state even allowed a former ex-husband and buddy within days of the fire to enter private property and literally cut up the crime scene (the home) and dump it into a river. Only a person who has motive and something to hide goes to those extremes. Think about the fact the couple were no longer married. The only ties to the couple were the children. The ex-husband had no legal interest in the home or its contents.
The position of the body and the lack of smoke in her lungs after the fire shows Sheila Deviney was murdered.
Sheila's family, since her murder, has been trying to get the District Attorney's office in Oklahoma to open the case. The former elected officer refused to do his job and ignored the case. Now, with a different District Attorney elected into office, the case is still being ignored.

As we wait for the cobwebs to be dusted off the desk of Oklahoma DistrictAttorney, Greg Mashburn, this particular cold case and facts into Sheila Deviney's murder will not be ignored by the Intimate Partner Homicide Investigation team ofSheryl McCollum, Holly Hughes and Susan Murphy Milano.
If you have any information on this case please contact us by email atIPHInvestigation@gmail.com. All information received will be kept confidential.
In the weeks ahead we will provide others facts on this case and keep you updated on any new developments.

clip_image002      "Let us be very clear about the true state of the psychologist's art. Psychologists do not know any more about behavior than the average man or woman in the jury box or the judge's robes. Psychologists do not know what causes behavior and they are entirely incapable of pinpointing some hypothetical event in the past that has led to the present state of an individual. They do not know what got done, how it got done, or whodunit. And not only are they unable to predict future behavior any better than the man or woman on the street, they are actually worse at it, blinded as they are by the illusion of their own expertise. Diagnostic categories are not validly established and diagnoses cannot be rendered reliably. Neither can therapy be reliably used to change the behavior of our citizens, juvenile or adult, violent or simply wayward.

"Psychologists have no special ability to read into the soul-or mind or psyche-of another human with any more accuracy than the rest of us. Upon finishing graduate or medical school they are not given special soulographs or psychometers that let them plumb the depths of anyone's psychological being. There simply is no mental stethoscope, no matter how much our justice system wishes there were.

"Clinicians are not trained to perform the myriad tasks the legal system asks them to perform because no body of knowledge exists to support such training. It is a sorry state of affairs, but it is the only state we've got."

Requiem for a child... and common sense-‘2 year old brain dead’ FATHER HIT him and HIT him and HIT him and..

http://www.miamiherald.com/2010/08/07/1766177/requiem-for-a-child-and-common.html#ixzz0w02iMe5U

By Leonard Pitts lpitts@MiamiHerald.com

This is a requiem for Willy Brown.

As these words are written, he lies brain dead and on life support at Miami Children's Hospital. By the time you read this, there's a good chance he will have been disconnected and declared dead. He is, or he was, two years old. His father, 23-year-old Lee Willie DeJesus of Homestead, is in jail, having been denied bond. Prosecutors expect to charge him with first-degree murder.

According to a confession police say DeJesus supplied, here is what happened: Monday night while the child's mother was at work and he was supposed to be babysitting, DeJesus strapped on a pair of boxing gloves and took aim at his son. He hit him. And hit him. And hit him.

And hit him. And hit him.

And hit him. Up to 15 times over 15 minutes about the head, face and torso, including one punch that knocked the little boy off the bed, causing him to strike his head on the floor. DeJesus told police he was trying to teach his son to box.

This is a requiem for intelligence.

You know, common sense, basic brain function. When a man thinks a two-year-old is ready to learn the manly arts of self-defense and proceeds to teach them by beating the stuffing out of him, is that not a sign that the last flickering candle of cognition has been well and truly snuffed? Is it not a signal that plodding, atavistic stupidity has finally seized the day, planted its flag, ascended the throne?

So yes, this is a requiem for common sense.

It is also a requiem for idealized memory.

Meaning the communal recollection of fatherhood as the province of strong and tender men who laid down the law and told their stories of walking to school through mountains of snow, who gave you their shoulders as a perch, their truths as a guide, who were never too busy to sip invisible tea from tiny doll cups or have a catch in the backyard as twilight gathered into evening.

It is an ideal that evaporates like dew in the face of the increasingly common reality of father as callow boy-man who has no idea how to fulfill the role to which circumstance has called him, often because he had no father of his own to teach him.

So this is a requiem for idealized memory. But it is also a requiem for Lee Willie DeJesus.

Whatever he was, whatever he could have been, died when he killed his son. But then, he was probably dead to his own possibilities long before that.

There are many things a boy needs his father to teach him: how to be honest and industrious; how to hit the water and not the porcelain; how to shave your beard or tie a tie; how to treat a lady.

But like too many men, DeJesus apparently thought the primary lesson he had to teach his son was violence. This, he must have thought, would make his boy a man.

And this is a requiem for tomorrow's victims.

Meaning the little boys and girls who grow up hit more often than they are hugged, left by blind mothers in the care of broken men who have no sense of self, no definition of role, no clue.

Police say that after his son became unresponsive, DeJesus waited as much as an hour before calling 911. Initially, he blamed the beating on a babysitter before finally confessing what he had done.

DeJesus' mother, Maria DeJesus, told CBS 4 she did not think her son was capable of the crime of which he stands accused.

"He might be capable of beating her [the boy's mother], but they always go at it, but then she goes right back to him. And if he did, he knows I love him. He knows what time it is. He knows he's got to suffer with the consequences."

This is a requiem for a handsome little boy named Willy Brown. And also an epitaph:

He deserved better.

INDEPENDENCE, Mo. --

A boy has been charged in juvenile court with second-degree murder in connection with his father's shooting death this week, authorities said Thursday afternoon.

The man was shot Monday and later died at an area hospital, Independence police said. Neighbors said the boy, 11, shot his father.

Neighbors and the man's ex-wife, who is not the boy's mother, had asked for mercy, saying the father was mentally unstable and the boy lived a very difficult life. The boy's mother lives out of state.

The shooting occurred at 1016 S. Woodland Ave. in Independence.

It was not immediately known whether court officials would seek to have the boy tried as an adult.

Cultural/Religious Beliefs No Defense to or Justification for Domestic Violence

New Jersey is certainly a melting pot if people of different races, religious and cultures.  What may be normal or acceptable in one religion or culture, may not fall within the acceptable laws or mores of our society.  On July 23, 2010, the Appellate Division decided the case of S.D. v. M.J.R. which was a reported (precedential) opinion addressing just this issue.

In this case, the parties were citizens of Morocco and practiced the Muslim faith.  They wed in Morocco in July 2008 in an arranged marriage when the wife was 17 and shortly thereafter, came to NJ for the husband's employment as an accountant.  Not long after, the wife sought a restraining order alleging harassment, assault, criminal restraint, sexual assault or criminal sexual.  The trial judge found that harassment and assault occur ed, i.e. acts of domestic violence occur ed, but that the wife did not need a restraining order for her protection.  Part of this was because he believed that there was a no contact order in connection with the corresponding criminal case and part because he thought that the parties would have little reason to see each other any more (a curious finding because the alleged sexual assault resulted in a pregnancy and there was going to be a custody litigation in Morocco.).

Despite stating that unwanted sexual relations occur ed, the trial judge did not find sexual assault or criminal sexual conduct to have been proven, stating:

This court does not feel that, under the circumstances, that this defendant had a criminal desire to or intent to sexually assault or to sexually contact the plaintiff when he did. The court believes that he was operating under his belief that it is, as the husband, his desire to have sex when and whether he wanted to, was something that was consistent with his practices and it was something that was not prohibited contact.

In other words, the judge found no criminal intent because religious custom clashed with the law. The Appellate Division reversed finding that the only necessary intent was to commit the sexual act, not the intent to commit a criminal act. Put another way, the fact that his religion may have permitted the conduct does not justify it legally. As such, the denial of the Final Restraining Order was reversed and an FRO was entered.
